A HIGH Court hearing will be held over a council’s decision to allow 260 homes to be built in a North Yorkshire town.
Ryedale District Council’s planning committee approved plans by Gladman Developments for the scheme in Kirkbymoorside in August, but it then emerged committee member Coun David Cussons, who had moved for the application’s rejection, had inadvertently pressed the “approval” button on the voting system.
That meant the vote was deadlocked at 2-2 and the development was approved on committee chairman Coun John Raper’s casting vote.
However, Judge Behrens, sitting in the Leeds High Court, has now granted claimants William Shaw and Brian Hewitt permission for a judicial review of the council’s decision.
Gladman Developments is contesting the proceedings.
