Legal fears over Kirkbymoorside homes

A COUNCIL’S legal chief has said revoking a controversial decision to approve a 260-home development in a Ryedale town could cost millions of pounds, as five councillors call for the scheme to be blocked.
An extraordinary meeting of Ryedale District Council will be held on Monday after the authority allowed Gladman Develop-ments to build the houses at Westfield in Kirkbymoorside. The local town council is considering a judicial review of the decision.
Next week’s motion will see councillors vote on a motion that the planning approval should be revoked and the council should not contest any judicial review over the scheme.
However, a report by the council’s solicitor and monitoring officer Anthony Winship said looking to revoke the planning permission would be “a potentially irrational decision” which would not be considered “reasonable and lawful”, and could cost the council between £3 million and £5 million in compensation.
The report said the council had sought independent legal advice and did not think it would be able to convince the Government that it was right to revoke the planning approval, if such a decision was challenged.
